Analyze emerging market, enforcement, and policy trends affecting government contractors in FY 2024–25. With False Claims Act (FCA) recoveries still at record highs and the current administration expanding both trade and health-care oversight, contractors need to stay proactive across the following fronts: 

  • Health-Care Enforcement Risks: DOJ focus on Medicare Advantage risk-adjustment fraud, especially chart coding and score inflation. Renewed enforcement of Stark Law self-referral violations and improper telehealth billing.
    • Inflation Reduction Act drug-pricing controls raising new compliance expectations for pharma contractors.
    • DOJ-HHS FCA Working Group Announcement and discussion of future enforcement areas signaled by the creation of this group.
  • Tariff & Trade Compliance Challenges: Discuss recent developments in the utilization of the False Claims Act to enforce changing tariff compliance requirements.  
    • FCA exposure for misstated country-of-origin claims?and inadequate supplier vetting.
  • Enhanced data analytics & AI-enabled monitoring for tariff classifications, import valuations, Medicare Advantage risk scores, and FCA exposure. 
    • Expected use of increased data transparency TDR on GSA contracts to negotiate pricing and impacts on False Claims Act enforcement for GSA contracts.
  • Broader FCA enforcement now targeting trade compliance (mis-stated country of origin) and civil-rights-based claims, alongside cyber matters.
