VSCPA Writes Letter in Support of PATENT Act

Dear Sen. Warner,

On behalf of the 12,000 members of the Virginia Society of CPAs (VSCPA), we would like to express our strong support for the Patent Act, and we respectfully request that you work toward its passage by the Senate.

In recent years, unscrupulous firms looking to capitalize on ambiguous laws have threatened to sue companies here in Virginia and around the country. These firms, so-called patent assertion entities (PAE), do not make or produce anything. Instead, they use old patents to threaten legitimate businesses — often for simply using products made by someone else.

Under existing law, businesses in our state have been sued simply for using a product — like their office copier — that a PAE claims violates a patent. Fortunately, there is a solution in the Senate that will protect businesses from this abusive litigation. The PATENT Act (The Protecting American Talent and Entrepreneurship Act of 2015) will help put an end to patent litigation abuse and will provide the businesses the VSCPA represents protection from threatening patent trolls. 

Companies in Virginia are looking to expand, but their growth is threatened by the actions of those that take advantage of loopholes in the patent litigation system to profit off of others. If we want to commit to creating new jobs and growing our economy, we must crack down on these harmful and illegitimate threats from patent assertion entities.

We urge you to support The PATENT Act and share your support with Leader McConnell and your colleagues in leadership. Please ask them to bring this bill to the floor of the U.S. Senate for a vote without delay.
